BioFires CC Terms and Conditions
Note: BioFires CC only delivers within South Africa - orders placed from clients for delivery outwith South Africa will not be honoured, a administration fee of 10% of the total purchase price will be charged if a transaction has to be refunded.
Description of goods and/or services
BioFires CC is a business in the décor industry that markets Ethanol Fireplaces, Biofires, BioFireplaces and BioFuel.
*When you click to make a purchase with us legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms and conditions. If you do not understand and agree to all our terms and conditions please refrain from using the site.
Once payment is made for the purchase, it is deemed that you have read and understood the terms and conditions for such purposes.
General Site Usage Terms
The content contained on the site may be used by you for your own personal, non-commercial shopping and information purposes only. In using the site you agree not to infect it with any computer programming (such as a virus) that may damage, interfere with, delay or intercept any data or information on the site and you shall indemnify BioFires CC for any damage caused by any such act attributable to you.
BioFires CC may suspend the site or any part thereof or terminate your account at any time if BioFires CC should determine that you are not using the site in compliance with this agreement or if BioFires CC believes the information provided by you is untrue, inaccurate or incomplete.
Use of Voucher Codes
The client / buyer is responsible for making sure they correctly insert the voucher code when promted – if the codeis not inserted then no discount will be applied. BioFires will not refund discounts if coupon code is not used.
No Refunds will be offered on products purchased using the coupon code.
Any voucher codes offered by BioFires are not available in conjunction with any other BioFires offers.
Intellectual Property
BioFires CC retains all copyright in all material, including logos and other graphics, which form part of the site.
All data and information communicated to or from the site and/or any site information and database remain and shall be the sole property of BioFires CC.
BioFires CC grants you permission to view, electronically copy and print in hard copy portions of the site for the sole purpose of browsing the site and placing an order, for your personal use only.
Any other use of materials on the site, including a reproduction for purposes other than those noted above, modification, distribution or reproduction, without the prior written consent of BioFires CC and the lawful trademark and/or copyright owner (if applicable) is strictly prohibited and constitutes an unlawful infringement of the intellectual property rights of BioFires CC and/or such trademark and/or copyright owner.
Customer privacy policy
BioFires CC shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Accepted Payment options
Payment may be made via Visa and MasterCard credit cards or by bank transfer into the BioFires CC bank account, the details of which will be provided on request. We do not accept American Express. Payments by cheque will be subject to 7 days clearance.
Credit card acquiring and security
Credit card transactions will be acquired for BioFires CC via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy. Customer details will be stored by BioFires CC separately from card details which are entered by the client on PayGate’s secure site. For more details on PayGate refer to www.paygate.co.za Merchant Outlet country and transaction currency. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
Responsibility
BioFires CC takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
Delivery policy
Subject to availability and receipt of payment, requests will be processed within 14 working days and delivery will be detailed by way of email; this email will contain your waybill number and details of what the client must do at the time of delivery. Our courier service is Triton Express Freight; all delivery costs within South Africa are included in the cost of your purchase. Orders placed for delivery outside South Africa will not be honoured, a administration fee of 10% of the total purchase price will be charged if a transaction has to be refunded.
Return and Refunds policy
The provision of goods and services by BioFires CC is subject to availability. In cases of unavailability, BioFires CC will refund the client in full within 30 days. Cancellation of orders by the client will attract a 10 % administration fee. Refunds on damaged goods will only be applied if the goods were checked at the time of delivery and marked on the Triton Express waybill – The goods will remain the responsibility of BioFires CC until the waybill is signed, then responsibility is passed in full to the client. Failure to mark damages on the waybill at the time of the delivery, will, in the event of a claim, render the client fully responsible for the damage to the purchase.
Export restriction
The offering on this website is available to South African clients only.
Use of Purchases
BioFires, GlassFires, BioFuel and all related products are used and stored at the clients own risk.
Country of domicile
This website is governed by the laws of South Africa and BioFires CC chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature. (This site is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law.)
Variation
BioFires CC may, in its sole discretion, change this agreement or any part thereof at any time without notice.
Company information
This website is run by BioFires CC based in South Africa and with registration number 2005/023345/23. BioFires CC is owned by Marius Bezuidenhout (director). The Directors decision is final where any dispute arises.
